Terms and conditions of sale
1. Purpose and scope
These terms govern the services sold by CGENIAL.COM, a French EURL with share capital of 18,000 euros, 99 avenue du General Leclerc, 94700 Maisons-Alfort, France, SIRET 320 435 415 00072, RCS Créteil 320 435 415, on the site benamedbyai.com.
These services are sold to businesses only, acting in the course of their trade. Placing an order means accepting these terms in full.
2. Services
The main service, the AI Visibility Audit, reference AUDIT-001, comprises ten commercial questions put separately to ChatGPT, Gemini, Claude and Perplexity, the time-stamped retention of the forty answers received, an analysis report, the identification of the competitors named, and action priorities. The detail is set out on the product page, which forms part of the contract.
3. Price
Prices are stated in euros. The AI Visibility Audit is sold at 450 €, a fixed price, paid once. As the service is supplied business to business outside the European Union, French VAT is not applicable, article 259-1 of the French General Tax Code. Any tax due in the buyer's own country is the buyer's responsibility. The price that applies is the one displayed on the day of the order.
4. Ordering and payment
Orders are placed online. Payment is made by PayPal or by card through PayPal's secure interface. No banking data travels through this site or is kept by CGENIAL.COM.
The order is firm as soon as payment is received. An invoice is sent by email.
5. Information to be supplied by the client
Carrying out the service requires the client to supply his trade, the areas he serves, his city, his services or products, and his main competitors. The delivery time starts only when those details are received, together with payment.
The client warrants the accuracy of the information supplied. CGENIAL.COM cannot be held responsible for an analysis distorted by inaccurate or incomplete details.
6. Delivery time
The report is delivered electronically within 72 hours of receiving payment and the necessary information. Should anything prevent this, the client is informed and offered a new date.
7. No guarantee of result
The service is a best-efforts obligation, not an obligation of result. The artificial intelligence systems queried change continuously, belong to third parties and are not under the control of CGENIAL.COM.
Accordingly, no guarantee of citation, position, ranking or visibility is given or promised. The report describes a state observed on the day and at the hour of the queries, and proposes actions. It does not promise their effect.
8. Right of withdrawal
As these services are sold only to businesses acting in the course of their trade, the right of withdrawal provided by consumer law does not apply.
9. Ownership and confidentiality
The delivered report belongs to the client, who may use it freely and pass it to his own providers. The analysis method, the question grids and the template documents remain the property of CGENIAL.COM, a registered trademark.
Information supplied by the client is treated confidentially and is disclosed to no third party.
10. Liability
The liability of CGENIAL.COM is limited to the amount actually paid for the service concerned. It cannot be engaged for indirect loss, in particular loss of turnover, of custom or of reputation.
11. Personal data
The processing of personal data is described in the privacy policy, which forms part of these terms.
12. Complaints and disputes
Any complaint must be addressed to [email protected]. An amicable solution will always be sought first.
These terms are governed by French law. Failing an amicable agreement, and as these services are concluded between businesses, any dispute falls under the exclusive jurisdiction of the courts of the district of the registered office of CGENIAL.COM.
